  The Export and Import Law The Ministry of Commerce may carry out the necessary actions on the condition as per the provisions in the Law in respect of the matters of export and import including determining the restricted goods, prohibited goods and banned goods for export and import and issuing permit and determining conditions relating to permit for export and import goods.

  The Ministry of Commerce, in exercising the power conferred under sub-section (b) of Section 13 of the Export Import Law, issues the following notifications relating to the import licensing:

  
  

  Notification No. 18/2015

  
  

  The Ministry of Commerce issued Notification No. 18/2015 to allow the importation of foreign wines in accordance with the wine importation procedures attached. Alcohol, beer and wine were previously limited to import but were allowed for sale in duty-free shops or under the recommendation of the Ministry Hotel and Tourism. The notification liberalizes the importation of wine to registered companies or associations that have obtained importer registration. The companies must apply for wine import registration certificate and wine import license at the Ministry of Commerce, and must have dealership from respective companies. The notification details the requirements for the application of the wine import license, such as the original proforma invoice or sale contract, wine import registration certificate and FDA recommendation. It also prescribes the rules to be followed by the importers, such as the requirement to import wine only via sea or air routes, disclosure of country of origin, will have to comply with relevant excited laws and other relevant laws and regulations.

  The Ministry of Commerce issued Import Negative list which needs to apply license, covering 4818 items with HS Code 10-digit-level out of total items of Myanmar Customs Tariff version 2017 with Notification No. 61/2017.

  
  

  Notification No. 7/2018

  
  

  The Ministry of Commerce issued a notification allowing Myanmar nationalities to export or import gold, jewelleries, artwork and accessories made of gold in accordance with the guidelines published in conjunction with the notification. The guidelines allow the trading of these items in foreign currency via sea, air and border trade channels. Application for exporter/importer registration certificate, with endorsement of the Mining Department and the Myanmar Gems Enterprise, is required the application for export/import license. The term of the license is 30 days with the additional 10 days permitted for extension. Exporter/importers are also required to obtain approval from the Gold Market Monitoring and Evaluation Committee regarding the quantity, standard, price and value of the exported/imported items. The details on the registration and license application requirements, prohibited activities, taxation, payment and custom inspection can be found in the Notification No. 7/2018.

  
  

  Notification No. 57/2018

  
  

  The Ministry of Commerce Notification No.57/2018 permits the importation of office supplies and items related services business to foreign companies, non-government organizations and branches of foreign companies. The importing entities are required to file an application for a registration number in order to import office supplies and services business-related items for their own use, and are prohibited from reselling them.

  
  

  Notification No. 6/2019

  
  

  The Ministry of Commerce extended the permission to allow the importation of used machineries in 2019 under the conditions prescribed. Importers must apply for permission to import used machines at the Ministry of Commerce, and submit details such as the brand name, capacity, model year, country of origin, energy source, recommendation from the Industry Supervision and Inspection Department, pre-shipment inspection certificate issued within 6 months before the arrival of the shipment and description for use. The machines must have been in use for less than ten years, excepting special circumstances, and function at 80% capacity. The details can be found in the Notification No. 6/2019.

  
  

  The Supervisory Committee for the Import of Vehicles issued a notification stipulating the manufacturing date for the automobiles to be imported in 2019. The notification stipulates the model year for various types of automobiles imported under used car plan (inclusive of consignment basis), individual plan and government plan. The detailed information on the manufacturing date stipulated for different categories of automobiles can be found in the Notification No. 1/2018.

  Notification No. 18/2021: List of products subject to import licensing under Export and Import Law

  
  

  The Ministry of Commerce, in exercising the power conferred under sub-section (b) of Section 13 of the Export Import Law, issues the following notifications relating to the import licensing:

  The Ministry of Commerce issued the list of imported goods which needs to apply license, covering 1428 tariff lines at the HS 6 digit-level or 3070 tariff lines at the HS Code 10 digit-level out of total items of Myanmar Customs Tariff version 2017 with Bulletin No. 18/2021 and will be subject to apply the import licenses starting from 1 January 2022 so as to remedy negative impacts of the Covid‑19 outbreak, to adjust the use of foreign currency, and to ensure the fair and equitable application of import licenses and administration. All products listed in the annex of this Notification are allowed to be imported into Myanmar by land, sea, and air after obtaining an import license from the Department of Trade in line with prescribed laws, rules, and regulations.

  
  

  The list of the tariff line items that are subject to import licensing shall be published in phases to provide businesses enough time to prepare for the changes.

G/LIC/N/2/MMR/4) and it covers the 451 tariff lines at the HS 6 digit- level or 826 tariff lines at the HS Code 10 digit-level out of total items of Myanmar Customs Tariff version 2017 with Bulletin No. 1/2022. The purpose is to remedy negative impacts of the Covid-19 outbreak, to adjust the use of foreign currency, and to ensure the fair and equitable application of import licenses and administration and it will be subject to apply the import licenses starting from 1 March 2022.   The Ministry of Commerce has issued the list of imported goods which need to apply a license as the additional list of the second phase with Bulletin No. 2/2022 (as the following process of the first phase and second phase which were circulated with documents G/LIC/N/2/MMR/4 and G/LIC/N/2/MMR/5) and it covers the 57 tariff lines at the HS 6 digit-level or 141 tariff lines at the HS Code 10 digit-level out of the total items of Myanmar Customs Tariff version 2017. The purpose is to remedy negative impacts of the Covid-19 fourth wave outbreak, to adjust the use of foreign currency, and to ensure the fair and equitable application of import licenses and administration. It will be subject to applying import licenses starting from 2 March 2022 and all products listed in the annex of this bulletin are allowed to be imported into Myanmar by land, sea, and air after obtaining an import license from the Department of Trade in line with prescribed laws, rules, and regulations.

  
  

  As already mentioned in the previous notifications, the list of the tariff line items that are subject to import licensing are being published in phases and the last phase shall be published in the short term and it will cover over 1,000 tariff lines at the HS Code 10 digit-level out of the total items of Myanmar Customs Tariff version 2017.

  
  

  The total tariff line items that are subject to import licensing are being prepared to publish as in one notification and the internal process of publishing that notification takes nearly two months.

  The above measures (19/2023 and 8/2023) will apply starting from 22 June 2023 instead of 1 June 2023. The effective date changes in order to use the Myanmar tradenet 2.0 system without any delay and to be able to use the system more easily for importers.
