Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

Como regla general, la importación de los productos no requiere licencias a la importación; sin embargo, existen algunos productos que precisan de permisos, autorizaciones, certificados y/o visados para su importación, por motivos de seguridad pública, sanidad animal o vegetal, o protección del medio ambiente.

El Salvador cuenta con el Centro de Trámites de Importaciones y Exportaciones (CIEX El Salvador) del Banco Central de Reserva, Sección de Importaciones, que es el organismo encargado de centralizar, agilizar y simplificar los trámites de importación y exportación.

Actualmente se está trabajando en un proceso de mejora gubernamental a fin de reducir los tiempos de respuestas para aquellos productos que requieran autorización de importación, siempre y cuando la documentación requerida esté completa sea presentada y con antelación a la importación.

La importación de productos generadores de radiaciones ionizantes, están sujetos a una autorización previa al ingreso al territorio nacional de dichos artículos, la cual podrá obtenerse a través de la Dirección General de Salud del Ministerio de Salud.

La finalidad de estas licencias es lograr un nivel adecuado de protección y seguridad a los trabajadores ocupacionalmente expuestos, a los pacientes, a la población y al medio en general.

Antes de que se realice la importación, de tal forma de que cuando el producto ingrese al país, ya cuente con la licencia (permiso) de importación. Generalmente, las licencias (permisos) de importación son extendidas de manera ágil y oportuna. Actualmente se está trabajando en un proceso de mejora gubernamental para reducir los tiempos de respuestas, siempre y cuando la documentación requerida esté completa y con antelación a la importación.

Se rechaza solamente si no cumple con los requisitos de ley establecidos. Sí, por escrito. Existen recursos de revisión ante la misma institución en la que se solicitó la licencia o permiso de importación. El Salvador cuenta con una Ley de Procedimientos Administrativos que regula el procedimiento de revisión en instancia administrativa para resolver la resolución denegatoria. Agotada la instancia administrativa, también existe la posibilidad de interponer una demanda en los juzgados de lo Contencioso Administrativo que son los competentes para verificar la legalidad y resolver las controversias de carácter administrativo que se suscitan entre la administración pública y los particulares.

Todas las personas/importadores tienen derecho a solicitar las autorizaciones de importación, ya sean personas naturales o jurídicas, incluso extranjeros con carné de Residencia.

Generalmente son 30 días. No, tienen que solicitarla de nuevo. Se consideran casos especiales en los que la mercancía viene en tránsito y ha habido algún atraso.

No hay sanciones para la no utilización de licencias o permisos de importación.
