Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

El sistema de licencias de importación está regulado por la Ley 23 de 15 de julio de 1997, Título III "Disposiciones generales para el Trámite de Licencias de Importación emitidas por las instituciones del Estado" y la Resolución Nº 5 de 18 de noviembre de 1998 "Reglamento Mediante el cual se Administra el otorgamiento de Licencias para la Importación de Productos sujetos a Contingentes Arancelarios".

Purposes and Coverage of Licensing

El sistema tiene dos tipos de licencias: licencias automáticas de importación y licencias no automáticas de importación, las primeras tienen fines estadísticos y las segundas se aplican a aquellos volúmenes de mercancía que pueden ingresar al territorio aduanero pagando un derecho de importación inferior al derecho corriente.

Las solicitudes de licencia deben presentarse previo a la llegada del producto al puerto de entrada. En caso de la llegada al puerto de productos sin licencias, se evalúa el riesgo sanitario y de acuerdo a ello se hace un retenido; posteriormente se otorga la licencia.

La Dirección Ejecutiva de Cuarentena Agropecuaria es el único órgano administrativo encargado de examinar las solicitudes de licencias que no tengan límites cuantitativos.

Q8. Under what circumstances may an application for a licence be refused other than failure to meet the ordinary criteria? Are the reasons for any refusal given to the applicant? Have applicants a right of appeal in the event of refusal to issue a licence and, if so, to what bodies and under what procedures?

Aparte de los criterios ordinarios para el rechazo de una licencia, no existe ninguna otra circunstancia.
Cuando nos referimos a los criterios ordinarios se trata a los estipulados en nuestra Ley 135 de 30 de abril, Orgánica de la Jurisdicción Contencioso-Administrativa de 1943 reformada por las leyes 33 de 1946 y 39 de 1954 y les serán aplicables todas las disposiciones que, al respecto, establezca el Código Judicial.
Por la vía gubernativa proceden los siguientes recursos en los asuntos administrativos de carácter nacional.
a) El de reconsideración ante el funcionario administrativo de la primera instancia, para que se aclare, modifique o revoque la resolución.
b) El de apelación, ante el inmediato superior, con el mismo objeto.

Las causas se le hacen saber al solicitante por escrito. Las decisiones de las autoridades competentes en materia de expedición y otorgamiento de licencia en el caso de denegación de una licencia, el solicitante tiene derecho a interponer los recursos legales pertinentes. Sí.

Eligibility of Importers to Apply for Licence

Al realizarse la importación, el importador debe presentar la copia de la liquidación de aduanas debidamente cancelada y la boleta de cancelación de pago.

La expedición de licencias no está supeditada al pago de un depósito de un adelanto.

Sin embargo, la efectividad de la importación se garantiza mediante el establecimiento de una fianza equivalente al 20 por ciento del precio cotizado para cada oferta de compra o de venta, fianza que deberá entregarse antes del inicio de la rueda y garantizará la seriedad de las propuestas que se presenten en la rueda de negociación, el cumplimiento del contrato de operación adjudicado, la importación del producto en el período asignado y los derechos que cause dicha importación.

Conditions of Licensing

Q14. What is the period of validity of a licence? Can the validity of a licence be extended? How?

La licencia es válida durante un período de 60 días a partir de la fecha de su expedición. El período de validez puede prorrogarse si el solicitante así lo pide.

Q15. Is there any penalty for the non-utilization of a licence or a portion of a licence?

No se impone ninguna sanción por la no utilización total o parcial de una licencia.
