Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

Los productos contemplados en la Resolución Ministerial Nº 150/15 del Ministerio de Industria y Comercio requieren de una autorización previa. Las licencias se aprueban en todos los casos en que se cumplan con los requisitos establecidos, y son consistentes con lo dispuesto por el artículo 2 del Acuerdo sobre procedimientos para el Trámite de Licencias de Importación de la Organización Mundial de Comercio.

Purposes and Coverage of Licensing

El trámite de licencia de importación de Calzados es automático. Se aplica a las siguientes partidas arancelarias de la NCM establecidas la Resolución Ministerial Nº 150/15 del Ministerio de Industria y Comercio.

Q3. The system applies to goods originating in and coming from which countries?

El sistema de aplicación abarca todos los países de origen y procedencia.

Q4. Is the licensing intended to restrict the quantity or value of imports, and if not, what are its purposes? Have alternative methods of accomplishing the purposes been considered and if so which? Why have they not been adopted?

Su finalidad es administrativa para obtener datos estadísticos. El trámite no tiende a limitar ni la cantidad ni el valor de las importaciones.

Q5. Cite the law, regulation and/or administrative order under which the licensing is maintained. Is the licensing statutorily required? Does the legislation leave designation of products to be subjected to licensing to administrative discretion? Is it possible for the government (or the executive branch) to abolish the system without legislative approval?

Decreto N°10.350/2012 “Por el cual se crea el Registro de Importadores de Productos del Sector Calzados y se establece el Régimen de Licencia Previa de Importación”. Resolución MIC Nº 150/15 “Por la cual se reglamenta y actualiza El Decreto N° 10.350/12, "Por la cual se crea el Registro de Importadores de Productos del Sector Calzados y se establece el Régimen de Licencia Previa de Importación" y se deroga la Resolución N° 1029 del 10 de octubre de 2014”. Si es obligatorio. La normativa ya establece los productos sujetos a licencia. El Poder Ejecutivo tiene la facultad de suprimir este sistema sin el acuerdo del Poder Legislativo.

No se maneja límites cuantitativos ni de valor a la importación de calzados procedentes de otros países.

Q6.II. How is the size of the quotas determined: on a yearly, six-monthly or quarterly basis? Are there cases where the size of quota is determined on a yearly basis but licences are issued for imports on a six-monthly or quarterly basis? In the latter case, is it necessary for importers to apply for fresh licence on a six-monthly or quarterly basis?

Las licencias se asignan a todos los importadores de calzados inscriptos en la Dirección Nacional de Aduanas y en el Registro de Productos del Sector Calzados del Ministerio de Industria y Comercio. Se emiten autorizaciones digitales que deben ser presentados conjuntamente con el resto de la documentación exigida al momento del despacho a plazo de las mercaderías. No aplica. No se comunican, sin embargo, las informaciones están disponibles a solicitud de los interesados.

Las licencias automáticas se emiten dentro de los plazos estipulados por el Acuerdo.

El período de validez de la Licencia de Importación es de treinta (30) días corridos a partir de su emisión.

Q6.VII. Is consideration of licence applications effected by a single administrative organ? Or must the application be passed on to other organs for visa, note or approval? If so, which? Does the importer have to approach more than one administrative organ?

El órgano administrativo es el Ministerio de Industria y Comercio.

Q6.VIII. If the demand for licences cannot be fully satisfied, on what basis is the allocation to applicants made? First come, first served? Past performance? Is there a maximum amount to be allocated per applicant and, if so, on what basis is it determined? What provision is made for new importers? Are applications examined simultaneously or on receipt?

Para el trámite de todas las licencias de importación se utiliza el criterio del orden cronológico de presentación de las solicitudes. No hay límites a la cantidad de licencias por importador.

Q6.IX. In the case of bilateral quotas or export restraint arrangements where export permits are issued by exporting countries, are import licences also required? If so, are licences issued automatically?

Las solicitudes de licencias pueden ser presentadas en cualquier día hábil anterior a la fecha del despacho de importación.

Q7.b. Can a licence be granted immediately on request?

Cuando el producto no ha llegado en el tiempo establecido, por motivos diversos y presentando una solicitud, sí puede extenderse siempre y cuando se realiza una petición.

Sí.

No existen otras causas de rechazo más que las que devienen del incumplimiento de los requisitos. En todos los casos son notificadas al interesado a los fines de subsanar los errores observados.

Eligibility of Importers to Apply for Licence

Q9. Are all persons, firms and institutions eligible to apply for licences: (If not, is there a system of registration of persons or firms permitted to engage in importation? What persons or firms are eligible? Is there a registration fee? Is there a published list of authorized importers?) a) under restrictive licensing systems? b) under non-restrictive systems?

Todas las personas o empresas tienen derecho al registro. Tienen derecho a solicitar licencias todos los importadores inscriptos como tales en el Registro de Importadores de la Dirección Nacional de Aduanas y en el Registro de Importadores de productos del sector Calzados dependiente de la Subsecretaria de Estado de Comercio del Ministerio de Industria y Comercio. Se percibe un derecho de registro.

Documentational and Other Requirements for Application for Licence

Q10. What information is required in applications? Submit a sample form. What documents is the importer required to supply with the application?

La información que debe figurar en las solicitudes de licencias de importación es la proporcionada en los respectivos formularios de solicitud.

Los documentos que debe presentar son:
(a) Formulario de solicitud de Licencia Previa de Importación, consignado en la plataforma predeterminada por el VUI.
(b) Nota dirigida al Ministro de Industria y Comercio.
(c) Lista de empaque.
(d) Factura Comercial de exportación al Paraguay de los productos visada o legalizada, la misma deberá contener en forma detallada la descripción y el precio unitario de los productos.
(e) Conocimiento de Embarque.
(f) Certificado de cumplimiento tributario expedido por la Subsecretaria de Estado de Tributación del Ministerio de Hacienda.

Q11. What documents are required upon actual importation?

En todos los casos se exigen los documentos requeridos para los despachos de importación además de las Licencias de Importación.

Q12. Is there any licensing fee or administrative charge? If so, what is the amount of the fee or charge?

Si se percibe una tasa equivalente a 7 jornales mínimos, los cuales ascienden a Gs. 549.535, reglamentada en la Resolución Nº 64/14 del Ministerio de Industria y Comercio.

Q13. Is there any deposit or advance payment requirement associated with the issue of licences? If so, state the amount or rate, whether it is refundable, the period of retention and the purpose of the requirement.

Si, está supeditada al pago de la tasa equivalente a 7 jornales mínimos, los cuales ascienden a Gs. 549.535, reglamentada en la Resolución Nº 64/14 del Ministerio de Industria y Comercio.

Conditions of Licensing

Q14. What is the period of validity of a licence? Can the validity of a licence be extended? How?

La Licencia de Importación de Productos del Sector Calzados es válida por treinta (30) días contados a partir de la fecha de su concesión, existe la posibilidad de prórroga a pedido del importador.

Q15. Is there any penalty for the non-utilization of a licence or a portion of a licence?

No.

Q16. Are licences transferable between importers? If so, are any limitations or conditions attached to such transfer?

Las licencias son de carácter intransferible y sólo son entregadas a los titulares de las mismas o a las personas autorizadas o apoderadas, debidamente acreditadas como tales.

Q17. Are any other conditions attached to the issue of a licence? a) for products subject to quantitative restriction? b) for products not subject to quantitative restriction?

No.

Other Procedural Requirements

Q18. Are there any other administrative procedures, apart from import licensing and similar administrative procedures, required prior to importation?

No.

Q19. Is foreign exchange automatically provided by the banking authorities for goods to be imported? Is a licence required as a condition to obtaining foreign exchange? Is foreign exchange always available to cover licences issued? What formalities must be fulfilled for obtaining the foreign exchange?
