Q1. Licencia para la importación de semillas, plantas, productos terminados o semielaborados de cannabis con fines medicinales o de investigación científica. Decreto 246/021, Ley 19.172.
Los interesados en importar y exportar semillas/plantas/ terminados o semielaborados de cannabis con fines medicinales o de investigación científica, deberán solicitar la correspondiente Autorización de Importación/Exportación a la División Sustancias Controladas del Ministerio de Salud Pública (MSP) de acuerdo a lo establecido en la normativa vigente.

En todos los casos presentados las licencias se aplican a cualquier origen.

El trámite de licencias no está destinado a limitar la cantidad de importaciones.
Q5. Cite the law, regulation and/or administrative order under which the licensing is maintained. Is the licensing statutorily required? Does the legislation leave designation of products to be subjected to licensing to administrative discretion? Is it possible for the government (or the executive branch) to abolish the system without legislative approval?
El trámite de licencia es, en todos los casos presentados, obligatorio. La legislación establece, en todos los casos, los productos sujetos al trámite, con excepción de la licencia "Exclusiones de prohibición de importar vehículos usados", la cual fue introducida por Ley, el resto de las licencias referidas fueron introducidas por Decretos del Poder Ejecutivo.

Con la licencia aprobada, el Documento Único Aduanero (DUA) se puede numerar en forma inmediata.

En todos los casos el trámite se lleva adelante en forma electrónica a través de la Ventanilla Única de Comercio Exterior (VUCE), que gestiona la solicitud con el organismo competente. El importador efectúa trámites ante un solo organismo. La solicitud de la licencia para la importación de semillas, plantas, productos terminados o semielaborados de cannabis con fines medicinales o de investigación científica la realiza la División Sustancias Controladas del MSP.
Q6.VIII. If the demand for licences cannot be fully satisfied, on what basis is the allocation to applicants made? First come, first served? Past performance? Is there a maximum amount to be allocated per applicant and, if so, on what basis is it determined? What provision is made for new importers? Are applications examined simultaneously or on receipt?

En todos los casos se pedirá entrega de factura comercial.

En todos los casos se exigen los documentos habituales requeridos para la apertura del Documento Único Aduanero (DUA).

La Dirección Nacional de Industrias cobra 0,2 UR por licencia presentada. Unidad Reajustable (U.R) – Valor ajustado según el índice medio de salarios y que es calculado por el Instituto Nacional de Estadísticas (INE).
Q13. Is there any deposit or advance payment requirement associated with the issue of licences? If so, state the amount or rate, whether it is refundable, the period of retention and the purpose of the requirement.
No es el caso en Uruguay.
Conditions of Licensing
Q14. What is the period of validity of a licence? Can the validity of a licence be extended? How?
Las licencias para la importación de semillas, plantas, productos terminados o semielaborados de cannabis con fines medicinales o de investigación científica, las cuales tienen una duración de 120 días. En el caso de plazos mayores, se deberá realizar una nueva gestión de la licencia.
Q15. Is there any penalty for the non-utilization of a licence or a portion of a licence?
No se impone sanción por la utilización parcial o total de la licencia.
Q16. Are licences transferable between importers? If so, are any limitations or conditions attached to such transfer?
No son transferibles.
Q17. Are any other conditions attached to the issue of a licence? a) for products subject to quantitative restriction? b) for products not subject to quantitative restriction?
No existen otras condiciones.
Other Procedural Requirements
Q18. Are there any other administrative procedures, apart from import licensing and similar administrative procedures, required prior to importation?
Q19. Is foreign exchange automatically provided by the banking authorities for goods to be imported? Is a licence required as a condition to obtaining foreign exchange? Is foreign exchange always available to cover licences issued? What formalities must be fulfilled for obtaining the foreign exchange?
No es necesario poseer licencia para obtención de divisas. En Uruguay hay libre disponibilidad de divisas y de transferencia de capital y utilidades desde y hacia el exterior.
