Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

On 23 December 2020 the U.S. Department of Commerce (Commerce) published final regulations (85 FR 83804) to establish the Aluminum Import Monitoring and Analysis (AIM) system. In January, the effective date of the regulations was delayed until March 2021 (86 FR 7237) and in March 2021, the regulations were stayed until 28 June (86 FR 17058). On 21 May 2021, Commerce published an additional rule (86 FR 27513) in the federal register, confirming that the regulations establish the AIM system would go into effect on 28 June 2021.

The system was established pursuant to Commerce's authority under the Census Act, as amended (the Census Act) (13 U.S.C. 301(a) and 302), Commerce established a system of import licensing to facilitate the monitoring of imports of aluminum articles, including monitoring for import surges The AIM system operates in a similar way as the SIMA system (19 CFR part 360) and has been codified under 19 CFR part 361. The AIM system tracks the modified SIMA system as closely as possible except where necessary to address the inherent differences between steel and aluminum imports.

Purposes and Coverage of Licensing

The aluminum import licensing program covers basic aluminum products (unwrought and wrought). In total there are 66 products covered, each identified by HTS number; the full list is available on Aluminum Products by HTS Codes (https://www.trade.gov/aluminum-products-hts-codes).

Q3. The system applies to goods originating in and coming from which countries?

The aluminum licensing system applies to goods originating in and coming from all countries.

Q4. Is the licensing intended to restrict the quantity or value of imports, and if not, what are its purposes? Have alternative methods of accomplishing the purposes been considered and if so which? Why have they not been adopted?

This licensing is not intended to restrict the quantity or value of imports. It is designed to provide fast and reliable statistical information on aluminum imports to both the government and the public.

Q5. Cite the law, regulation and/or administrative order under which the licensing is maintained. Is the licensing statutorily required? Does the legislation leave designation of products to be subjected to licensing to administrative discretion? Is it possible for the government (or the executive branch) to abolish the system without legislative approval?

Aluminum import licenses may be applied for up to 60 days prior to the expected date of importation and until the date of filing of the entry summary documents, or in the case of FTZ admission, the filing of Customs and Border Protection (CBP) Form 214. The license is valid for 75 days.

Q7.b. Can a licence be granted immediately on request?

Yes. The license number is electronically generated, and electronically given to the filer immediately upon completing the license information.

Q7.c. Are there any limitations as to the period of the year during which application for licence and/or importation may be made? If so, explain.

Applicants are not refused aluminum license numbers.

Eligibility of Importers to Apply for Licence

Q9. Are all persons, firms and institutions eligible to apply for licences: (If not, is there a system of registration of persons or firms permitted to engage in importation? No. Only registered users are permitted to file aluminum licenses.

The registration form is available on the aluminum import licensing website: https://www.trade.gov/us-industry-licensing. The registrant fills in the requested demographic information and sends it to the aluminum license team electronically. The team issues the registrant a unique user id to access the license module. There is no registration fee, and licenses are free. Information of registered users is kept confidential.

Documentational and Other Requirements for Application for Licence

Q10. What information is required in applications? Submit a sample form. What documents is the importer required to supply with the application?

The license filer submits demographic information from the registration, and entry specific information detailing 10-digit Harmonized Tariff Schedule (HTS) number, volume in kilograms, country of most recent cast, country of largest smelt, and country of second largest smelt and value in U.S. dollars for each product imported.

Q11. What documents are required upon actual importation?

The 9-digit aluminum license number is required as part of the CBP Entry Summary for goods brought into the U.S. for consumption.

Q12. Is there any licensing fee or administrative charge? If so, what is the amount of the fee or charge?

There is no licensing fee.

Q13. Is there any deposit or advance payment requirement associated with the issue of licences? If so, state the amount or rate, whether it is refundable, the period of retention and the purpose of the requirement.

Conditions of Licensing

Q14. What is the period of validity of a licence? Can the validity of a licence be extended? How?
