Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

El requerimiento de Autorización Previa para productos que afectan la salud pública o la seguridad del Estado es la excepción al régimen de libre importación de mercancías vigente en Bolivia a partir de la promulgación de los Decretos Supremos No.21060 y No.22407 de 29 de agosto de 1985 y 11 de enero de 1990, respectivamente y de la Ley No.1182 de 17 de septiembre 1990.
Las "Disposiciones Generales para los Regímenes Aduaneros de Importación e Internación Temporal" en su artículo 9, aprobadas mediante Decreto Supremo No.24440 de 13 de diciembre de 1996 reglamentan el trámite de Autorización Previa.

Los productos que requieren Autorización Previa, son otorgados sin discriminación de origen o procedencia. Por tanto, son automáticas y las otorgan el Ministerios de Salud y Previsión Social, Ministerio de Gobierno - Viceministerio de Defensa Social; Estupefacientes psicotrópicos y alcaloides en general y sus derivados farmacéuticos, sólo para establecimientos autorizados y en las condiciones previstas por la Ley No.1008
Productos químicos y sustancias controladas de conformidad a la Ley No. 1008 de 19 de junio de 1988, sobre el régimen de la coca, sustancias controladas y disposiciones conexas.

Las licencias automáticas no son aplicadas con fines estadísticos, las restricciones a la importación están de conformidad con los artículos XX y XXI del GATT de 1994.

Las solicitudes son libres y pueden hacerlas las empresas, instituciones y personas jurídicas que cumplan con las normas legales de comercio, sean nacionales o extranjeras.

Documentational and Other Requirements for Application for Licence

No existe un formulario único para solicitar Autorización Previa para la importación, sin embargo el importador debe presentar:
- Solicitud de Autorización, mediante memorial que consigne la siguiente información:
- Nombre o razón social.
- Producto a importarse.
- Cantidad, detalles físicos y técnicos.
- Modo de transporte.
- Detalles adicionales que se estime conveniente.
- Factura comercial (proforma de origen).
- Registro Único de Contribuyente (RUC) (fotocopia).
- Registro de Comercio.

Q11. What documents are required upon actual importation?

La Resolución de Autorización Previa se presentará en ejemplar válido para efecto del despacho aduanero y señalará el término de validez que en ningún caso modificará los plazos previstos en las disposiciones generales para cada operación aduanera.

No se percibe ningún derecho para la autorización.

La expedición de autorización no está supeditada al pago de un depósito ni de un adelanto.

Conditions of Licensing

El período de validez de una Autorización Previa varía de acuerdo al producto.

Para conseguir una prórroga el requisito es seguir los pasos de una nueva solicitud no existiendo ninguna sanción por la no utilización total o parcial de una Autorización.

Las Autorizaciones no son transferibles entre importadores, el trámite debe efectuarse a título personal del interesado.

La expedición de una Autorización no está subordinada a ninguna condición.
