Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

Para importar plaguicidas de uso agrícola se requiere que el producto esté previamente autorizado por el SAG, quien además fiscaliza todas las solicitudes de importación de plaguicidas, a nivel de puertos de entrada a nuestro país, aplicando las normas y procedimientos señalados en la Resolución N° 1.038 de 2003, con el fin de comprobar la identidad de los plaguicidas y su correspondiente composición química.
Si el plaguicida no se encuentra dentro de los productos autorizados por el SAG, el interesado/a deberá solicitar su autorización, procedimiento normado por la Resolución Nº 1.557 de 2014, y sus modificaciones Resolución 1.400/2015,1.208/2016 y 5.482/2016.
Los plaguicidas que no están previamente autorizados se rechazan, ordenándose reexportación o destrucción, el proceso de solicitar la autorización toma alrededor de 24 meses y no es posible mantener la carga en el puerto ese periodo.

Purposes and Coverage of Licensing

Solo podrán ingresar al país aquellos plaguicidas de uso agrícola autorizados por el Servicio Agrícola y Ganadero (el listado se encuentra disponible en la página https://www.sag.gob.cl/ambitos-de-accion/evaluacion-y-autorizacion-de-plaguicidas) o en el caso de que el plaguicida no se encuentre dentro de los productos autorizados por el SAG, el interesado/a deberá solicitar su autorización, procedimiento normado por la Resolución Nº 1.557 de 2014, y sus modificaciones Resolución 1.400/2015,1.208/2016 y 5.482/2016. En caso de los plaguicidas microbianos, se rigen por la Resolución Nº 9.074 desde el año 2018.

Las normas y procedimientos bajo las cuales se mantiene la licencia son la Resolución N° 1.038 de 2003, la Resolución Nº1.557 de 2014, y sus modificaciones Resolución 1.400/2015,1.208/2016 y 5.482/2016, y la Resolución Nº 9074/2018 para los plaguicidas microbianos.

La solicitud debe presentarse en los puertos de ingreso, el Servicio Agrícola y Ganadero procederá a una inspección documental. Una vez realizada, se determinará si procede la inspección física de la partida. Si ésta es aprobada, el plaguicida estará en condiciones de ingresar al país, siempre que no esté afecto al muestreo oficial. En tal caso, el lote deberá ser muestreado y quedará retenido a la espera de la calificación del Informe de Resultado de Análisis.

El examen de solicitud de la licencia es llevado a cabo únicamente por el Servicio Agrícola y Ganadero.

Q8. Under what circumstances may an application for a licence be refused other than failure to meet the ordinary criteria? Are the reasons for any refusal given to the applicant? Have applicants a right of appeal in the event of refusal to issue a licence and, if so, to what bodies and under what procedures?

Una solicitud puede denegarse si el resultado del análisis físico es diferente a la composición señalada en el documento "Autorizaciones de Plaguicidas de Uso Agrícola" vigente al momento del muestreo, habiendo considerado las tolerancias establecidas en la Resolución Exenta Nº 386 de 1983 o aquella que la reemplace o modifique, el interesado podrá solicitar a la Oficina del Servicio correspondiente, analizar la primera contramuestra que se encuentra en su poder, en un laboratorio autorizado distinto del primero. Si esta contramuestra arroja un resultado que está dentro de los rangos permitidos, el Servicio enviará a un tercer laboratorio autorizado, la segunda contramuestra que se encuentra en su poder, para confirmar el resultado anterior.
Si por el contrario la primera contramuestra arroja un resultado que confirma el primer análisis, el producto deberá ser destruido o reembarcado en un plazo no superior a 180 días y su costo será de cargo del interesado o su representante.

Eligibility of Importers to Apply for Licence

Documentational and Other Requirements for Application for Licence

Para solicitar la autorización para importar un plaguicida, el interesado debe presentar en la Oficina del SAG correspondiente al puerto de ingreso, la siguiente documentación:
- Certificado de Destinación Aduanera (CDA), indicando el número de autorización dado por el SAG para cada plaguicida de uso agrícola.
- Copia de la Hoja de Seguridad del plaguicida, según lo dispuesto en la Ley N° 18.164.
- Informe de Inspección de Productos Agropecuarios (IIPA).
- Certificado Original de Análisis de Composición, expedido por el fabricante o formulador del plaguicida, para cada lote de plaguicida, el cual debe indicar número de lote de fabricación, ingrediente activo, concentración, formulación, volumen y país de origen.
- Factura en original que indique volumen de la partida a internar, monto y valor CIF o FOB.
- Manifiesto de carga, conocimiento de embarque o guía aérea del medio de transporte.
