Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

Reglamento de Ascensores, Escaleras Mecánicas y Andenes Móviles; constituye el ordenamiento del diseño, fabricación, instalación, explotación, mantenimiento, reparación e inspección periódica así como de la importación de los ascensores, escaleras mecánicas y andenes móviles.

Purposes and Coverage of Licensing

Se aplica a los equipos utilizados en la transportación de personas y cargas, con independencia de la velocidad de desplazamiento, excepto:

a) Las plataformas elevadoras plegables, autopropulsadas, las torres elevadoras de cargas y personal, las plataformas elevadoras monomástil y bimástil, los andamios colgantes eléctricos que son rectorados por el Ministerio de la Construcción;

b) los funiculares u otras instalaciones de cables;

c) los de elevación en las de minas;

d) los ascensores de cremallera;

e) los aparatos de elevación destinados al movimiento de actores durante las representaciones artísticas;

f) los instalados en medios de transporte o en una máquina;

g) los destinados exclusivamente al acceso a puestos de trabajo, incluidos los puntos de mantenimiento e inspección de la máquina, o que discurran a lo largo de una escalera o rampa, o sirvan una distancia vertical menor que la existente entre dos plantas de un edificio;

h) los especialmente diseñados y fabricados para fines militares.

Resolución 106 del Ministerio de la Industrias del año 2001. Es obligatorio para los productos que regula. Por el carácter eminentemente técnico del tema es potestad del Gobierno su implementación para lo cual está facultado por la Ley al ser designado el OACE Organismo Rector de esta tecnología en el País.

La Notificación de Aprobación de Importación se formalizará antes de la firma del contrato de suministro por parte de la Importadora. Para importar los equipos referidos se requiere de la Autorización Técnica de Importación, emitida por el Grupo Nacional de Ascensores (GNA) al menos 30 días antes de la fecha prevista para la firma del contrato.

La solicitud de Autorización Técnica al GNA para la importación de los equipos referidos es individual por cada equipo y debe contener el Dictamen Técnico Operacional del equipo que se sustituye o moderniza; las normas técnicas bajo las que se fabrica el equipo; datos técnicos detallados que definen el suministro que se importa y su inscripción previa, aportando la certificación de calidad confeccionada sobre la base de norma cubana vigente, emitida por el fabricante o un tercero; y dirección y dictamen técnico del inmueble donde se monta el equipo.

Las solicitudes de importación pueden ser rechazadas en caso de que no cumplan con el Reglamento de Ascensores, Escaleras Mecánicas y Andenes Móviles o que se trate de sustituir un equipo existente que aún tiene vida útil y es posible mantenerlo en explotación con la seguridad requerida. En estos casos se le comunican las razones al solicitante se le hace saber que esa decisión puede ser apelada ante la Dirección General del Ministerio de Industrias.

La solicitud será presentada por la empresa importadora dirigida al Jefe del Grupo Nacional de Ascensores, a la misma se le adjuntará para la inclusión de los proveedores en el inventario que realiza el GNA, las especificaciones técnicas del producto, manuales de Operación, Montaje y Mantenimiento, así como los catálogos de Piezas de Repuesto y las certificaciones de Calidad que los respaldan, emitidas por el fabricante o un tercero confeccionado sobre la base de norma cubana vigente.
