Outline of Systems

Q1. Give a brief description of each licensing system as a whole and, with respect to each, reply to the following questions as relevant, placing all of the material with respect to a given system in sequence together, and using cross references as appropriate when elements which have already been described are also present in another system.

Las normas son aplicables a la importación y exportación de metales preciosos y piedras preciosas por personas jurídicas cubanas y extranjeras en el territorio de la República de Cuba. A los efectos de esta regulación se consideran:

- Metales preciosos: el oro y la plata, en forma bruta, semilabrada y en polvo.
- Piedras preciosas: el diamante, el zafiro, el rubí y la esmeralda, en forma bruta, tallada y sin engarzar.

La importación de metales preciosos y piedras preciosas por personas jurídicas, en las formas antes descritas, es libre siempre que su destino se corresponda con el objeto social autorizado a ejercer y se cumplan los requisitos y formalidades establecidos en materia de despacho aduanero y otros que resulten aplicables. La importación y exportación de piezas desmonetizadas y de especímenes nacionales o extranjeros con carácter numismático, están sometidas a las regulaciones específicas dictadas al efecto.

Su finalidad es el control y la seguridad de los metales preciosos y piedras preciosas con vista a su preservación, prevenir y evitar acciones de tráfico ilícito de éstos de conformidad con la legislación vigente en Cuba y de las convenciones internacionales de las que nuestro país es signatario.

El sistema se aplica metales preciosos y piedras preciosas originarias y procedentes de cualquier país del mundo.

No se limita la cantidad o valor de las importaciones. Su finalidad es de protección y control.

Does the legislation leave designation of products to be subjected to licensing to administrative discretion? Is it possible for the government (or the executive branch) to abolish the system without legislative approval?

El fundamento jurídico de las licencias de importación de metales preciosos y piedras preciosas es el Decreto Ley 361 de 14 de septiembre de 2018 y la Resolución 80 de 2022 del Presidente del Banco Central de Cuba. Con este basamento el sistema de licencias es legalmente obligatorio. Se requiere por ley el otorgamiento de licencias. La legislación no deja la designación de productos sujetos a licencia a discreción administrativa y no es posible que el gobierno invalide el sistema sin la aprobación legislativa.

Las autorizaciones técnicas específicas que requieran ser otorgadas por una Autoridad Competente para ejecutar operaciones de importación deben obtenerse, previo a la suscripción del contrato que corresponda y en su defecto, siempre antes de la ejecución de la operación comercial entendida como la fecha de embarque de las mercancías, acorde al nivel de riesgo y características para cada caso en particular. Para este caso las solicitudes de permiso de importación se tramitan como mínimo con siete días previo a la importación de la mercancía.

Las solicitudes de licencia son examinadas por un órgano técnico-administrativo.

La obtención de los metales preciosos y piedras preciosas de forma ilícita. Si no está clara la información solicitada al importador se le solicitan más información que esclarezca la legalidad de la operación de importación. Si no se logra esclarecer la legalidad de la operación no se autoriza y se le hace saber al solicitante las causas del rechazo. La decisión de la autoridad es irrevocable.

Podrán solicitar la Autorización de Importación los importadores autorizados a realizar las importaciones de estos productos, según nomenclatura de productos aprobada a la entidad importadora por el MINCEX.

El solicitante debe presentar el documento de solicitud con los siguientes datos:

- Descripción de metales.
- Copia del contrato de Compraventa Internacional.
- Para que se utilizaran.

Al realizar la importación, debe presentar a la aduana la Autorización de importación emitida por el BCC.
